These Terms govern your use of our website and purchase of goods/services from Build Factory X.
These Terms and Conditions ("Terms") constitute a binding agreement between Build Factory X ("we," "us," or "our") and you ("you" or "your"), governing your use of our website and/or purchase of goods/services from us (collectively, "Services"). By using our website and/or making a purchase from us, you expressly agree to the following Terms.
1. Use of Services
- You shall not use our website and/or Services for any purpose that is unlawful, illegal or prohibited under Indian laws, or any other local laws that might apply to you.
- It is your responsibility to ensure that any goods, services, or information available through our website meet your specific requirements.
AI Assistant & Fair Usage Policy (FUP)
Build Factory X provides an interactive AI Assistant on our platform to help you navigate products, retrieve specifications, configure PC hardware, and fill details. To ensure equal access and protect our systems:
- Usage Limits: Each device is limited to a maximum of 5 queries every 3 minutes.
- FUP Policy: If you exceed the limit, a 3-minute cooldown timer will be enforced. This FUP guarantees fair distribution of resources.
- Allowed Usage: Attempts to abuse the AI, execute injections, write program code, or ask off-scope questions are blocked and constitute a violation of our terms.
Zero-Tolerance Security & Permanent Blacklist Rule
Any unauthorized attempt to access, probe, or breach the Admin Portal (/admin) or administrative functions without explicit store ownership authorization will result in an IMMEDIATE AND PERMANENT BLACKLIST / BAN across all Build Factory X services, custom build configurators, and purchasing capabilities. Security intrusion alerts are dispatched instantly to store management upon any unauthorized attempt.
2. Orders & Availability
- You agree to provide accurate and complete information for order fulfillment and service delivery. We shall not be liable for issues resulting from incorrect or incomplete information you provide to us.
- All purchases/orders are subject to availability.
- We reserve the right to cancel orders at our discretion, including but not limited to cases of non-availability of goods you wish to purchase from us or if the order is suspected of fraud.
Quotation Basis
All custom PC configurations submitted through our website are requests for quotation, not confirmed orders. Final pricing and exact specifications will be confirmed by us via direct contact before any payment is processed.
Component Availability
The PC hardware market is highly volatile. Build Factory X reserves the right to modify or suggest alternative component selections based on current market availability. Any changes will be strictly communicated and approved prior to billing.
Personal Hand-Delivery & Shipping Charges
To ensure components are completely safe from damage in transit, Build Factory X personally hand-delivers your PC via the safest modes of public transport (like trains or buses) instead of using standard third-party parcel couriers:
- Tamil Nadu: Delivery is completely free across all locations in Tamil Nadu.
- Other States / Outside Tamil Nadu: For deliveries to any other state (including Kerala, Karnataka, Andhra Pradesh, Telangana, or North India), customers are required to cover only the actual travel expenses (bus or train fare) of our delivering team member. Build Factory X does not charge any administrative or markup shipping fees.
3. Payments & Financing
- Payments must be made in full at the time of purchase unless otherwise agreed upon by us.
- You must ensure that the payment details provided are valid and belong to you.
- All payments are securely processed through our integrated gateways, including Zoho Payments (Zoho Pay) and Razorpay.
EMI & Financing Policy
- Prebuilt PCs (Razorpay Credit Card EMI): EMI options for prebuilt PCs are assisted and processed via Razorpay using Credit Cards. All interest rates, extra charges, and EMI tenures are determined and charged solely by Razorpay and the issuing bank. Build Factory X does not charge any extra fee or markup for this.
- Custom PC Builds (Fibe & Bajaj Finserv): EMI/Financing for custom PC builds is facilitated through Fibe or Bajaj Finserv via personal loans. Build Factory X acts as a facilitator to help you apply for and secure the loan, but any processing fees, document charges, or interest rates are charged by Fibe, Bajaj Finserv, or their partner banks, NOT by Build Factory X.
- Eligibility & Approvals: All EMI/finance options are strictly subject to approval based on customer eligibility checks conducted by the respective financing partners.
- Liability & Payments: Once an EMI or loan is processed and active, Build Factory X is not responsible or liable for any monthly repayments, late fees, defaults, or collection issues. All repayment matters are solely between the customer and the respective financing company.
- Facilitation Support: Build Factory X will actively assist you in initiating and applying for the EMI/loan, and will help coordinate with the financing partners to sort out any processing or application issues that may arise in between.
4. Liability
- We shall not be liable for any loss or damage arising from the use of our Services, whether direct, indirect, or consequential.
- We shall not be liable for any loss or damage arising directly or indirectly from the decline of authorization for any transaction due to the Cardholder exceeding the preset limit mutually agreed upon with our acquiring bank.
3-Month On-Site Warranty Policy & Geographic Terms
- Guaranteed South India Coverage: Build Factory X provides 3 months of guaranteed on-site warranty support for custom PC builds across South India (Tamil Nadu, Karnataka, Kerala, Andhra Pradesh, Telangana, and Puducherry).
- Longer Distance Locations: For locations outside South India or extended distance regions, on-site technician visits are provided subject to BFX team availability (dispatched if a team member is free/available). If our team is not free/available for on-site dispatch due to distance, physical on-site warranty service is not applicable.
- Comprehensive Support Guarantee: Even if physical on-site service is not applicable for longer distances, Build Factory X will assist you in every possible way — providing full remote diagnostic support, step-by-step troubleshooting guidance, and complete facilitation of component warranty and RMA claims.
Warranty Exclusions
Our comprehensive warranty is strictly limited to hardware failure under normal operating conditions. The warranty does NOT cover:
- Manual or physical damage (e.g., dropped components, forcefully bent CPU pins, improper cable management by the user).
- Liquid damage of any kind (e.g., water spills, custom water-cooling leaks applied post-delivery).
- Damage caused by power surges or unstable electrical delivery at the user's premises.
5. Governing Law & Disputes
Any dispute arising out of the use of our website, purchase from us, or any engagement with us shall be subject to the laws of India. All legal claims shall be subject to the exclusive jurisdiction of the courts of Tamil Nadu, India.
